[1] Definition: “Vitoboxx (s)” means all packaged products furnished to customer by VITOMATIC.com whether shipped or delivered. Unless otherwise specified on the front of this document, VITOMATIC.com may ship or deliver, and customer agrees to accept, Vitoboxx sealed in individual boxes, filled with contents determined by VITOMATIC.com. If the Vitoboxx are not deemed suitable, VITOMATIC.com's sole obligation will be to replace or repair the Vitoboxx, but in no event will VITOMATIC.com be liable for poor sales or consequential damages. Unless otherwise specifically provided elsewhere in this document, VITOMATIC.com has no obligation to maintain any of the Vitoboxx after they have been delivered to Customer. Customer is responsible for sending an authorized representative to the assignment or for having an authorized representative review all Vitoboxx remotely during the delivery. If no review is made during the delivery, Customer is obligated to accept VITOMATIC.com's judgment as to the acceptability of all Vitoboxx.

[2] Rights: Unless otherwise specifically provided elsewhere in this document, no business logo or image licensed for use on a cover of a Vitoboxx may be used for promotional or advertising purposes without the express permission of VITOMATIC.com and the payment of additional fees. No rights are transferred to Customer unless and until VITOMATIC.com has received payment in full.

[3] Limits and Liabilities: VITOMATIC.com nor any of its directors, employees, or other representatives shall be liable for damages arising out of or in connection with the use of Vitoboxx contents. Specific medical advice should be obtained from a licensed health care practitioner. Consult your physician before you begin any nutrition, exercise, or dietary supplement program. Information regarding dietary supplements have not been evaluated by the food and drug administration and are not intended to diagnose, treat, cure, or prevent any disease.

[4] Payment: Product costs will be provided by Customer to VITOMATIC.com at time of order confirmation. An email will be sent to confirm the date when payment received by VITOMATIC.com and other important information such as expected shipment date and order confirmation number.

[5] Return: Call 1 937 241-5522 to receive an authorization number and return information. Merchandise must be returned within 30 days. Note: customers will be responsible for shipping charges on cancelled orders.

[7] Specific Vitamin Requests: Vitamins and Minerals offered in the Vitoboxx follow direction of scientific research and needs of bariatric patients. VITOMATIC.com acknowledges that bariatric surgeons may find specific vitamins/ minerals not offered in Vitoboxx are desired. VITOMATIC.com will consider requests to offer specific vitamin/ minerals in the Vitoboxx. Commitment to contractual purchases will be obligated by Customer to VITOMATIC.com.

[8]Handling fee will be added to costs, based on number of packages purchased.

[9] Prices: VITOMATIC.com strives to maintain prices at the lowest level. Occasionally, price is subject to change without notice.

[10] User Submissions: You agree that you will not upload or transmit any communications or content of any type that infringe or violate any rights of any party. By submitting communications or content to any part of this Site, you agree that such submission is non-confidential for all purposes. If you make any such submission, you automatically grant--or warrant that the owner of such content has expressly granted--Vitomatic a royalty-free, perpetual, irrevocable, world-wide nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display the communication or content in any media or medium, or any form, format or forum now known or hereafter developed. Vitomatic may sublicense it's rights through multiple tiers of sublicenses. Vitomatic reserves the right to take any action it deems necessary to protect the personal safety of our guests or the public. Vitomatic has no liability or responsibility to users of the Vitomatic Site or any other person or entity for performance or nonperformance of the aforementioned activities.

[12] Jurisdiction: You expressly agree that exclusive jurisdiction for any dispute with Vitomatic, or in any way relating to your use of the Vitomatic Site, resides in the courts of the State of Ohio and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of Ohio in connection with any such dispute including any claim involving Vitomatic or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers and content providers.

These Terms governed by the internal substantive laws of the State of Ohio, without respect to its conflict of laws principles. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
